What is Probate?
 
It is a legal process by which a title of an estate is transferred from the primary owner to his/her beneficiaries. Because the owner cannot take the property with him/her, the court will decide who's going to have it. If the owner of a property dies with a Will, the probate court decides if the Will is valid and sees to it that the property is correctly distributed according to the stated condition of the Will. However, if the owner did not leave a Will before he/she dies, the probate court assigns the claim of the estate to a person or persons according to the law of that state.

 

A Probate Law generally deals with the managing of the properties of people who are diseased. It exists to orderly manage the deceased person's estate and satisfactorily implement the decedent's terms stated in his/her will include the properly distribution of the remaining assets to the heirs and pay the debt that is left by the decedent. The process of Probate can be either simple or can be very complex. The level of complexity varies on a certain circumstances of each state. There are some courts that require a supervision of a lawyer to help with the administration of the asset.

 

Although it is a tough time to look for a lawyer when someone close to you has died, you still need to in order to handle the legal matters that pertain to the left assets of the decedent. You need to have someone who has the expertise in handling the issue. A probate proceeding takes place in a probate court in the state of the deceased person's legal residence at the time of his/her death.
